What payments are due if you register your pregnancy early?

Women have the right to receive benefits for early pregnancy registration in 2021. A one-time transfer of a certain payment amount is possible in accordance with Article 9 of Federal Law No. 81. It was adopted in May 1995.

However, not all patients registered with a medical organization are entitled to funds. Payment is possible to certain categories of citizens.

  1. Officially employed. The employer makes monthly contributions to the Social Insurance Fund (SIF), so benefits are possible.
  2. Those who closed their business. If the individual entrepreneur is still working, then all contributions must be paid in the year preceding the pregnancy.
  3. Dismissed due to bankruptcy or liquidation of the organization. They must be officially recognized as unemployed and given benefits.
  4. Civilian employees of military units.

State social security also guarantees benefits during pregnancy. They are put:

  • women military personnel;
  • students of secondary specialized educational institutions, universities, graduate students.

To receive benefits during pregnancy, you need to write an application to the head of the organization where the woman works or studies. The payment is not due to pregnant women who registered in the 1st trimester and underwent medical examination if they do not officially work anywhere. Social Insurance contributions are not paid from salary and payments are not issued.

The benefit can be received for six months after the end of maternity leave. If a woman applies after this period, she has the right to refuse payment. Everything will be decided individually.

The initial amount of benefits during pregnancy is 300 rubles. But according to Federal Law No. 81, this amount increases upon payment. It depends on two parameters.

  1. Regional coefficient, which is valid in the Far North and other areas with harsh climates.
  2. Taking into account the indexation of benefits (set every year by decree of the Government of the Russian Federation).

The amount of payments also depends on the month when the patient was registered. For example, if she first came to the antenatal clinic in January 2021, then the benefit amount is 613.14 rubles. In February, the payment is already 628.47 rubles. The benefit does not depend on whether two children were born or one.

Who will be able to receive benefits in 2018

A one-time benefit for registration in the early stages of pregnancy is awarded to women who (Article 9 of the Law of May 19, 1995 No. 81-FZ):

  • registered in medical institutions before 12 weeks of pregnancy;
  • have the right to maternity benefits (except for the adoptive parent).

You must apply for benefits within six months from the end of maternity leave. If you do not apply for the benefit within this period, the benefit will be “lost.” This is provided for in Article 17.2 of the Law of May 19, 1995 No. 81-FZ.

Payment to the Social Insurance Fund

In some cases, a woman will have to apply to the Social Insurance Fund (SIF) herself for maternity payments. This:

  • termination of activities by the employer on the day of application for benefits;
  • impossibility of paying benefits by the employer due to insufficient money in his bank accounts
  • inability to establish the location of the employer and his property, in the presence of a court decision establishing the fact of non-payment of benefits.

The following documents must be provided to the Social Insurance Fund at the place of registration of the employer:

  • application for payment of benefits;
  • a certificate from the antenatal clinic or other medical organization that registered the woman in the early stages of pregnancy (up to 12 weeks).

Benefit amount in 2021

The initial benefit amount was initially set at 300 rubles. But upon payment, this amount increases by (Articles 4.2, 5, 10 of the Law of May 19, 1995 No. 81-FZ)

  • indexation coefficient (set annually by the Government of the Russian Federation);
  • regional coefficient (this applies to territories classified as regions of the Far North and equivalent areas, and territories not classified as such regions and localities, but having special climatic conditions).

In 2021, there are two different benefit amounts (in January and from February 1). This is due to the fact that from February 1, 2021, the benefit for registration in the early stages of pregnancy was indexed by a factor of 1.025 (Resolution of the Government of the Russian Federation dated January 26, 2018 No. 74 “On approval of the amount of indexation of payments, benefits and compensation in 2021 year"). From January 1, 2021, the minimum wage was increased to 9,489 rubles. However, this increase did not in any way affect the benefit for registration in the early stages of pregnancy from January 1, since the minimum wage does not affect this type of benefit in any way. Legal regulation of payment

Legal information on issues related to the provision of this type of assistance to pregnant women by the state can be found in the following regulations:

Documents and purpose of the benefit

In 2021, depending on the situation, benefits can be issued:

  • at the employer (at the place of work);
  • in an educational institution;
  • in the social protection service.

Thus, if a woman does not work, then she can also receive benefits in 2021. But to do this, she does not need to contact her employer, social security authorities or her place of study.

When receiving benefits from an employer, assignment and payment must take place within 10 days from the date of submission of the registration certificate. When receiving benefits from the social security service, the benefit must be assigned within 10 days and paid no later than the 26th day of the month following the month the certificate was received.

To assign benefits, you will need to provide a certificate from a medical institution (for example, from a antenatal clinic) confirming registration in the early stages of pregnancy. This certificate must be issued by a doctor and signed and stamped on it (clause 22 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia dated December 23 No. 1012n).

Keep in mind that a single form of certificate as of 2021 is not approved by law. Accordingly, medical institutions have the right to compile it in any form. The certificate must be certified by the signature of the doctor and the seal of the medical institution.

You pay the benefit at the expense of the Social Insurance Fund at the same time as the maternity benefit. If the employee brings a certificate after paying for maternity sick leave, pay the benefit within 10 calendar days. The benefit is not subject to personal income tax and insurance contributions and is not included in expenses (clause 1 of Article 217, clause 1 of clause 1 of Article 422 of the Tax Code of the Russian Federation). One-time benefit for the birth of a child

A one-time benefit for the birth of a child is a cash payment guaranteed by the state to compensate for the costs associated with caring for a newborn. A family with any level of income and social status has the right to receive it.

The payment can be received by the child's mother, the child's father, or another legal representative. A similar payment is provided for the adoption of a child.

It turns out that in Moscow the amount of benefits is not affected by whether it is a normal pregnancy or a multiple pregnancy. And in St. Petersburg it still has an effect. If twins are born, you can get more than 70 thousand.

The difference in the amount of benefits in Moscow and St. Petersburg is large, but they cannot be directly compared. Both benefits are associated with registration before the 20th week, but in St. Petersburg this benefit is paid only after childbirth. In fact, this is a payment for the child, and not for the pregnant woman herself. In Moscow, too, there are payments for the child, but they are not related to when the pregnant woman registered.

Who will they give it to? For those who registered before week 20 and are registered in Moscow or St. Petersburg, including the unemployed.

What documents are needed? To receive the benefit you will need:

  1. Statement.
  2. Passport with registration information.
  3. Certificate of registration for pregnancy up to 20 weeks inclusive.

In St. Petersburg, a certificate is issued after childbirth in the antenatal clinic, unlike the one for federal payments. The date of registration is determined from the medical record.

When and how to get it. In Moscow - after the 20th week of pregnancy, as soon as you receive a certificate. The benefit is transferred to the account; it must be indicated when applying for benefits.

In St. Petersburg - only after childbirth. The benefit is transferred to a special card, which is created at the birth of a child. You can use it to pay for goods for children and baby food in certain stores. You cannot simply withdraw money from this card. When children don't need as much food, you can make an agreement with other parents and go to the store together. One will buy baby food, and the second will give him the money.

Benefits provided for by regional laws

All subjects of the Russian Federation, not only Moscow and St. Petersburg, can establish additional payments for pregnant women. What they will be depends on how much money there is in the region. Benefits are mainly established for low-income pregnant women.

In the Omsk region there is an additional benefit for those who registered for pregnancy before the 12th week - 2 thousand rubles.

In the Voronezh region there is an allowance for nutritious food; pregnant women receive an additional monthly payment of about 2 thousand rubles. But to do this, you need to prove that the family income is below the subsistence level in the region. In the Vladimir region there is also such a payment, but it is only 198 rubles.

In the Moscow region, pregnant women are provided with special nutrition according to doctor’s prescriptions. The rules are set by municipalities. For example, in Naro-Fominsk, pregnant women can receive 1 liter of milk, 500 ml of kefir with bifidobacteria and 1 kg of cottage cheese per month.

Such payments or similar ones exist in other regions. But in many cases there are no additional support measures for pregnant women. For example, this is exactly the case in my Saratov region. You can find out how things are in your region by contacting the local authorities that are responsible for social development and social protection.

Possibility of processing payments through the State Services website or through the MFC

Today, expectant mothers have the opportunity to receive a free service of providing a one-time benefit through multifunctional centers.

To do this, you first need to clarify whether you can use the desired service at the nearest branch of the MFC, for which you need to call a single phone number, or contact the nearest multifunctional center in a convenient way.

After that, you can personally receive an electronic queue coupon at the branch, wait and go to the employee’s booth, you can also sign up in advance.

If it turns out that the nearest MFC for one reason or another does not provide this service, then the woman has the opportunity to apply for benefits at any other branch.

When you visit the State Services website and select the service we are considering in the catalog, an entry in the MFC is displayed as a way to receive it.

What to do if they don't pay

Citizens' applications for benefits must be timely and confirm their right to payment.
It will not be prescribed if the pregnant woman has not submitted a certificate from a health care institution; the deadline for registration has expired. It is necessary to understand that the grounds for refusal in these cases are justified. If they are not legal, the woman has the right to contact the prosecutor’s office, which will conduct an audit of the organization’s work.

Another authority competent in these matters is the court; it determines how appropriate the refusal actions are. But you shouldn’t immediately run to law enforcement agencies. It is important to follow the pre-trial procedure - first contact your employer in writing for clarification.

If a pregnant woman wants to receive the intended amount, she should be informed about the mechanism for its payment, accrual, provision of the necessary information, and conditions for registration. This determines the correctness of her actions and the timeliness of contacting government agencies.

Applicants for

The following categories of citizens have the right to apply for the benefit in question::

  • employed women (officially registered under the Labor Code), who have the opportunity to receive support in the event of pregnancy thanks to compulsory social insurance;
  • unemployed women under the following conditions: forced dismissal in the event of bankruptcy of an enterprise, leaving individual entrepreneurship or private legal practice, notary practice, if unemployment occurred in the last previous year;
  • full-time students;
  • women in the military, as well as those working in customs, the Federal Penitentiary Service and other services equivalent to the military;
  • Individual entrepreneurs (individual entrepreneurs) who independently paid insurance contributions to social insurance funds.

Citizens of the Republics of Belarus, Kazakhstan, Armenia and Kyrgyzstan can also receive benefits in the usual amount if they work in Russia. It does not take into account whether they are temporarily staying, temporarily or permanently residing in our country.

Service provision period

  1. An application for a benefit is subject to consideration by the Administration within 10 days from the date of receipt (registration) of the application with all the necessary documents.
  2. Payment of state benefits to applicants is carried out by the Administration through federal postal organizations or credit organizations specified by applicants in the application, no later than the 26th day of the month following the month of receipt (registration) of the application with all necessary documents, based on the amount of state benefits assigned in accordance with the Federal Law of May 19, 1995 No. 81-FZ “On state benefits for citizens with children.”
