On 10/23/2018, a new order of the Federal Tax Service of the Russian Federation dated 10/02/2018 N ММВ-7-11/ [email protected]

This regulatory act approved a completely new form of the 2-NDFL certificate, as well as the procedure for filling it out and submitting it to the Federal Tax Service.

From the moment the new Order comes into force (from 01/01/2021), the following cease to apply:

  • Order of the Federal Tax Service of the Russian Federation dated October 30, 2015 No. ММВ-7-11/485 as amended. dated January 17, 2018, which approved the old certificate form, as well as the procedure for filling it out;
  • Order of the Federal Tax Service of the Russian Federation dated September 16, 2011 No. ММВ-7-3/576, which established the regulations for submitting information to the tax authorities.

What changed?

There are different forms of certificates for submission to the tax office and issuance at the request of the employee:

  1. Form 2-NDFL KND 1151078 (Appendix No. 1 to the Order);
  2. Certificate of income and tax amounts of an individual (Appendix No. 5 to the Order).

The name, structure and content of the certificate for the Federal Tax Service have been changed:

  • The discrepancy between the name and content of the document, which was observed earlier, has been corrected (now the form is called “Certificate of income and tax amounts of an individual”);
  • the new form contains fewer sections (3 instead of 5), but is located on two sheets: the “old” section 3 is placed on a separate page in the appendix “Information on income and corresponding deductions by month of the tax period”;
  • a code has now been added to the information about the details of the notice of granting deductions: “1” – provision of a property deduction to the taxpayer, “2” – social deduction, “3” – reduction of personal income tax by the amount of fixed advance payments (previously only the document number and the date of its issue were indicated) .

The Order is also accompanied by a new form for the register of certificates 2-NDFL (Appendix No. 1 to Appendix No. 4 of the Order), supplemented with lines for entering details (signs of submitted certificates) of reorganized legal entities.

In addition, the rules for submitting reports to the Federal Tax Service exclude the possibility of submitting 2-NDFL on electronic media (flash drives, disks, etc.). And when submitting the form through TCS channels, the previously existing limitation has been canceled: 3,000 certificates in one file.

The certificate that will be issued to employees is almost identical in appearance to the still valid form 2-NDFL. The line about the attribute, the adjustment number and the Federal Tax Service code, as well as the details of the notification of the provision of a deduction, have been removed from it. Otherwise, the order of filling remains the same.

    Hello. The employee is given a standard certificate form; no separate form is provided for such a case (clause 3 of Article 230 of the Tax Code of the Russian Federation).

    Disadvantages of Using Templates

    Deadlines for submitting 2-NDFL for 2021

    The deadline for submitting 2-NDFL to the Federal Tax Service is March 1 of the year following the reporting year. This period is the same for references:

    • provided in the general manner: with the sign “1” on the title page (clause 2 of Article 230 of the Tax Code of the Russian Federation);
    • sent to the Federal Tax Service for income on which tax could not be withheld: with the sign “2” on the title page (clause 5 of Article 226 of the Tax Code of the Russian Federation).

    Until 2021, the deadline for submitting a general certificate and a certificate for unwithheld personal income tax differed. A certificate for withheld personal income tax was submitted until April 1, for non-withheld personal income tax - until March 1.

    If the deadline falls on a weekend or holiday, it is postponed to the first working day (Clause 7, Article 6.1 of the Tax Code of the Russian Federation). Since the deadline for submitting 2-NDFL for 2021 falls on Sunday, it is postponed to the first working day - Monday 03/02/2020.

    The period for issuing a certificate requested by an employee is no more than 3 working days from the date of receipt of the request from him (Clause 3 of Article 230 of the Tax Code of the Russian Federation, Article 62 of the Labor Code of the Russian Federation).

    Filling out the certificate begins with the first, general section:

    • INN/KPP.

    Organizations indicate the 10-digit TIN and KPP number from the Certificate of Registration. Since the TIN line consists of 12 cells, you need to put dashes in the last two. Individual entrepreneurs indicate only the TIN, and the checkpoint line is crossed out. If the certificate is submitted by the OP, then the TIN of the parent organization and the checkpoint of the separate unit are indicated.

    • Help number.

    Indicate the serial number of the certificate. If a clarifying or canceling certificate is submitted, you must indicate the number of the previously submitted certificate.

    • Reporting year.

    According to the 2-NDFL certificate for 2021, we indicate “2019” accordingly.

    • Sign.

    Specify the value “1” - if a regular certificate is submitted (“3” if it is submitted by the legal successor) and “2” – if a certificate is submitted that indicates unwithheld personal income tax (“4” if it is submitted by the legal successor).

    • Correction number.

    If the certificate is submitted for the first time in a year (“primary”), enter the code “00”; if you are submitting an adjustment, indicate what it is according to the account: “001”, “002”, etc. For a cancellation certificate, the code is always the same - 99.

    • Submitted to the tax authority.

    Who submits 2-NDFL for 2021?

    Certificate 2-NDFL is drawn up and submitted to the Federal Tax Service by tax agents who paid income subject to personal income tax to their employees during the tax period. These include, in particular (Article 226 of the Tax Code of the Russian Federation):

    • organizations;
    • IP;
    • notaries, lawyers and other private practitioners;
    • separate divisions of foreign organizations in the Russian Federation.

    Who doesn't submit 2-NDFL?

    You do not need to submit 2-NDFL if:

    • The income was paid to an individual entrepreneur under a GPC agreement or to a self-employed citizen (payer of professional income tax).

    In this case, they pay the tax themselves.

    • During the tax period, no income was paid to employees.

    If during the year employees were on unpaid leave and did not receive income, there is no need to prepare a certificate for them.

    • The organization has only a director, who is the founder, with whom an employment contract has not been concluded and income to whom is not paid.

    If there is no activity and the director does not receive a salary, there is no need to draw up a “zero” certificate for him.

    • Income paid by one individual to another.

    In this case, the recipient of the income fills out not a 2-NDFL certificate, but a declaration in the 3-NDFL form and submits it to the Federal Tax Service at the place of registration at the end of the year in which he received the income. The one who paid him the income does not submit anything to the tax office, since he is not a tax agent.

    What can you expect with a translation of a personal income tax certificate?

    • If the certificate is filled out by hand, the data is entered into it from left to right, starting from the first left acquaintance. If on a computer, then the values ​​of numerical indicators need to be aligned to the right.
    • If there is no data in a certain field or line, you need to put a dash in it.
    • If there is no value in the field in which the amount is indicated, you must enter “0” in it.
    • There should be no negative values ​​in the certificate.
    • Help pages are numbered consecutively and the number is indicated in the format “001”, etc.
    • Data in 2-NDFL is entered in printed capital letters.
    • When filling out a document by hand, you can only use black, blue, and purple ink. When filling out on a computer, you must use Courier New font with a height of 16–18 points.
    • Errors cannot be corrected using putty or other corrective means. If you admitted it, it is better to redo the certificate.
    • Double-sided printing is not allowed, as is stapling sheets.

    The amount of the fine depends on the type of offense:

    • The certificate was submitted late (clause 1 of Article 126 of the Tax Code of the Russian Federation).

    The fine will be 200 rubles. for each document not submitted on time. If you are late submitting 2-personal income tax for 25 employees, you will be fined 5,000 rubles.

    • Errors were made in 2-NDFL (clause 1 of Article 126.1 of the Tax Code of the Russian Federation).

    For an error in the certificate, the fine will be 500 rubles. If, for example, you submitted 25 certificates and 5 of them with errors, then you will be fined in the amount of 2,500 rubles. Please note that the tax authority does not specify for which errors a fine is imposed. In the article Art. 126.1 of the Tax Code of the Russian Federation only talks about false information, but the legislator does not specify what this refers to.

    In its letter dated 08/09/2016 No. GD-4-11/14515, the Federal Tax Service of the Russian Federation indicates that unreliable information includes arithmetic errors, distortions of total indicators and other errors that entail adverse consequences for the budget. This also applies to errors in the TIN, full name, date of birth and passport details of the employee.

    But if you discovered an error earlier than the tax authorities and filed a corrective 2-NDFL, there will be no fine (clause 2 of Article 126.1 of the Tax Code of the Russian Federation).
