FSS pilot projects on direct payments and electronic sick leave are gradually covering all regions of the country. 1C accounting programs provide for the automation of data preparation, calculations and reports within the framework of these projects with the appropriate settings. General provisions

This Privacy Policy Statement (hereinafter referred to as the Statement) is an official document of Archa-service LLC, located at: 620144, Ekaterinburg, st.

The Privacy Policy describes how personal data is processed - any actions (operations) or a set of actions (operations) performed using automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating , change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

Relations related to the processing of personal data and information about users of the Site are regulated by these Regulations, other official documents of the Operator and the current legislation of the Russian Federation.

The processing of personal data is carried out on a legal and fair basis, reasonably and in good faith based on the principles:

  • the legality of the purposes and methods of processing personal data;
  • integrity;
  • compliance of the purposes of processing personal data with the goals predetermined and stated when collecting personal data, as well as with the powers of the Company;
  • compliance of the volume and nature of the personal data processed, methods of processing personal data for the purposes of processing personal data.

This Privacy Policy governs any type of processing of personal data and personal information (any personally identifiable information and any other information related thereto) about individuals who are consumers of the Company's products or services.

This Policy applies to the processing of personal, personal data collected by any means, both active and passive, both through the Internet and without its use, from persons located anywhere in the world.

The employer's obligation to join the electronic data exchange system

Federal Law of May 1, 2021 No. 86-FZ provides for the introduction of sick leave certificates in digital form.

The employer has an order to conduct clarifications with the staff, talk about the ELN and the right of employees to receive a certificate of incapacity for work in electronic form. However, not all companies have the technical equipment to process ELN. Then the employer can only ask his employees to receive sick leave on paper, but has no right to force them to do so.

An employer should think about joining the information space, as it provides benefits. ELN cannot be forged, there is no need to store it on paper, and there is no need to track the ink color and letter size. The built-in calculator will make the calculations, and the Social Insurance Fund will quickly receive the completed ENL and promptly check and transfer the benefits.

Collection of personal data

The purpose of processing personal data is to fulfill the Operator’s obligations to Users regarding the use of the Site and its services.

The processing of users' personal data is carried out with the consent of the subject of personal data to the processing of his personal data.

Personal data means any information relating to a directly or indirectly identified or identifiable individual (personal data subject) and which can be used to identify or contact a specific person.

A request for the User’s personal data may be made at any time, including when the User contacts the Company. The Company may use such data in accordance with this Privacy Policy. It may also combine such information with other information for the purpose of providing and improving its products, services, content and communications.

Below are some examples of the types of personal information that the Company may collect and how such information may be used.

Collection of personal data

Various data/information is collected including:

  • first and last name,
  • delivery address;
  • delivery city;
  • phone number;
  • E-mail address.

Personal data may also include additional information provided by Users at the request of the Operator in order for the Operator to fulfill its obligations to Users arising from the contract for the provision of services. The Operator has the right, in particular, to request from the User a copy of an identity document or other document containing the User’s first name, surname, photograph, as well as other additional data that, at the Operator’s discretion, will be necessary and sufficient to identify such User and will allow exclude abuse and violation of the rights of third parties.

When the User attracts other persons to the Company's events and activities or invites them to communications, the Company may collect personal data provided by the User about these persons, such as: first name, last name, date of birth, postal address, email address and telephone number.

When processing personal data, the Company ensures the accuracy of personal data, its sufficiency, and, where necessary, relevance in relation to the purposes of processing personal data.

Correcting errors in electronic sick notes

The human factor involves the occurrence of errors. Corrections are made to the sick leave statuses:

060 – sick leave filled by the employer.

070 – amounts payable have been accrued (for the “offset scheme”) or the “PVSO” register has been sent (for the pilot project for “direct payments”).

080 – amounts paid.

To make adjustments in your personal account, click the “Edit” button.

After which the necessary changes are made, the “Reason for corrections” and “Rationale for corrections” fields are filled in. Next, click “Save”.

To avoid errors, use the Manual Log, which displays the results of format and logical control and notifies you of the presence of errors.

When errors are detected by FSS employees, a notice regarding the benefit will appear in the manual.

Storage and use of personal data

Users' personal data is stored on electronic and/or paper media and processed using automated and non-automated systems.

Use of personal information

The collected personal data allows us to send notifications to the User about new products, special offers and various events. They also help the Company improve its services, content and communications. If the User does not want to be included in the mailing list, he can refuse the mailing list at any time by informing the specified contacts for feedback, as well as making changes in his profile settings on the site.

From time to time, the Company may use the User's personal data to send important notifications containing information about changes to terms, conditions and policies, as well as confirming orders placed/purchases made/services ordered. Since such information is important for the relationship with the Company, the User cannot refuse to receive such messages.

The Company may also use personal information for internal purposes, such as conducting audits, data analysis and various studies in order to improve the Company's products and services, as well as interact with consumers.

If the User participates in a prize draw, contest or similar promotion, the Company reserves the right to use the personal information provided to administer such programs.

Collection and use of non-personal information

Personal data that is not personal is also collected - data that does not allow it to be directly associated with any specific person. The Company may collect, use, transfer and disclose non-personal information for any purpose. The following are examples of non-personal information that the Campaign collects and how it may use it:

The Company may collect personal information such as occupation, language, zip code, unique device identifier, location and time zone in which a product is used in order to better understand consumer behavior and improve our products, services and communications.

The Company may collect personal data/information about what the user is interested in on the Company website when using other products and services. Such personal data/information is collected and used to help the Company provide more useful information to its customers and to understand which parts of the site, products and services are of most interest. For the purposes of this Privacy Policy, aggregate data is considered non-personal data/information.

If non-personal information is combined with personal information, the combined information will be treated as personal information for as long as the information is combined.

How to check your certificate of incapacity for work in your FSS personal account

At any time, an employee can open his personal account and view the status of his sick leave. In order to receive information, you must register on the State Services portal. In the login field you need to enter your phone number and password. After logging into your FSS personal account, you can view all electronic sick notes and find out the following information:

  • How much benefit is accrued:
  • Sick leave extended, opened or closed;
  • On what dates are you considered disabled;
  • Is the document drawn up correctly by the employer?

You can receive notifications about changes in sick leave status by email. In your FSS personal account, you can use the payment calculator function. You can independently calculate the approximate amount of sick pay. To do this, open the calculator in the upper right corner and fill in all the required fields.

The service will ask you about the reason and period of incapacity for work, as well as whether you were in a hospital and did not violate the regime. In addition, you will need to indicate the date when you started working at your last place of work, as well as the amount of wages you received over the last 2 years. It is worth noting that the result obtained depends on the regional coefficient.

After entering all the data, you should click on the “Calculate” button and the website will show the approximate cost that the accountant should charge you for the electronic sick leave.

Transfer of personal data

Personal data of Users is not transferred to any third parties, except as expressly provided for in these Rules.

The processing of the User's personal data is carried out without a time limit, in any legal way, including in personal data information systems using automation tools or without the use of such tools

The User agrees that the Operator has the right to transfer personal data to third parties, in particular, courier services, postal organizations, telecommunication operators, etc., solely for the purposes specified in the “Collection of Personal Data” section of this Privacy Policy

When specifying the user or with the user's consent, it is possible to transfer the User's personal data to third party counterparties of the Operator, subject to the acceptance by such counterparties of obligations to ensure the confidentiality of the information received, in particular when using applications.

Applications used by Users on the Site are hosted and supported by third parties (developers) who act independently of the Operator and do not act on behalf of or on behalf of the Operator. Users are required to independently familiarize themselves with the terms of service and personal data protection policies of such third parties (developers) before using the relevant applications.

The User’s personal data may be transferred at the request of authorized government bodies of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.

The Operator blocks personal data relating to the relevant User from the moment of application or request from the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in the event of detection of unreliable personal data or unlawful actions.

Disclosure of information to third parties

In some cases, the Company may share certain personal information and data with strategic partners who work with the Company to provide products and services, or those who assist the Company in marketing products and services to consumers. The Company provides third parties with the minimum amount of personal data necessary only to provide the required service or conduct the required transaction.

Personal information will be provided by the Company only for the purpose of providing consumers with products and services, as well as to improve these products and services, and communications related thereto. Such information will not be provided to third parties for their marketing purposes.

To use personal data for any other purpose, the Company requests the User's consent to the processing of his personal data.

Service Providers

The Company provides personal data/information to Companies providing services such as: information processing, granting loans, fulfilling consumer orders, delivery, other types of consumer services, determining the User’s interest in products and services, conducting surveys aimed at studying consumers or satisfaction with the quality of service . Such companies undertake to protect the User's information regardless of their country of location.

Other persons

The Company may be required - in accordance with the law, judicial procedure, legal proceedings and/or based on public requests or requests from government authorities in or outside the User's country of residence - to disclose personal data. The Company may disclose personal data/information about the User if it determines that such disclosure is necessary or appropriate for the purposes of national security, maintaining law and order or other publicly important cases.

The Company may also disclose personal data/information about the User if it determines that disclosure is necessary to enforce the Company's terms and conditions or to protect its business and users. Additionally, in the event of a reorganization, merger, or sale, the Company may transfer any or all of the personal information it collects to the applicable third party.

Innovations in calculating ELN in 2021

Let's start with the basic data involved in processing certificates of incapacity for work, regardless of whether you are processing a paper certificate or a digital one - the changes will affect everyone.

In 2021, the minimum wage (hereinafter referred to as the minimum wage) was increased, and now it is 12,130 rubles.

The limit on an employee’s total income for the year, which forms the upper limit for sick leave payment, in 2021 amounted to 865,000 rubles.

Thus, the new limit values ​​when calculating the amount of sick leave benefits are the corridor: from 370.85 rubles. up to RUB 2,150.68 for 1 day of incapacity.

As for sick leave certificates in digital form, their processing now takes less time, since, unlike the paper equivalent, the Social Insurance Fund receives the electronic health certificate and processes it faster.

Destruction of personal data

The user's personal data is destroyed when:

  • self-deletion by the User of data from his personal page (if such pages are provided for by the functionality of the site) using the “delete account” functionality available to the User using profile settings;
  • removal by the Operator of information posted by the User, as well as the User’s personal page in cases established by the purchase and sale agreement (offer);
  • when the subject of personal data withdraws consent to the processing of personal data.

Cookies and other technologies

The Website, interactive services and applications, email messages and any other communications on behalf of the Company may use identification cookies and other technologies, such as pixel tags, web beacons. Such technologies help the Company better understand user behavior, report which sections of the site have been visited by users, and measure the effectiveness of advertising and online searches. The Company considers information collected by cookies and other technologies as non-personal information.

The Company's goal in such cases is to provide a more convenient and personal interaction with the Company. For example, knowing the User's name, the Company can use it in its communications. By knowing that someone using a User's computer or device has purchased a particular product or used a particular service, the Company can better tailor advertising and email messages to the User's interests. Ultimately, all this knowledge helps to provide Users with the highest quality service.

The user can disable cookies in the settings of the web browser or mobile device they use. Please note that some website functions may become unavailable after cookies are disabled.

As with most websites, the Company collects some information automatically and stores it in statistics files. This information includes Internet Protocol (IP) address, browser type and language, Internet service provider, referring and exit pages, operating system information, date and time stamp, and clickstream information. The Company uses such information to understand and analyze trends, administer the Site, study user behavior on the Site, and gather demographic information about its general user population. The Company may use such information for its marketing purposes.

In some email messages, the Company may use clickable links to information posted on the Company website. When users click on such links before they reach the destination page on the Company's website, their requests are separately registered. Pixel tags allow the Company to send email messages in a consumer-readable format and indicate whether such messages have been read. The Company may use such information to limit or stop communications sent to consumers.

Electronic certificate of incapacity for work for direct payments

Advantages of electronic sick leave certificates in the direct payments project

The simultaneous participation of the policyholder in both FSS projects provides the organization with ample opportunities to automate the processing of benefits. The accountant is relieved of the responsibility for monitoring the falsification of sick leave certificates. The employer pays for the first three days of sick leave already registered with the Social Insurance Fund. However, the policyholder receives not only the benefits of two projects, but also the need to generate and submit reports separately for each of the projects.

Scheme of interaction with the participation of the policyholder in two projects

The interaction between the employee of the insured person, the employer - the policyholder, the Social Insurance Fund - the insurer and the medical institution in the case of the employer’s participation in the Social Insurance Fund ELN and direct payments projects is as follows (Fig. 6):

  1. The employee goes to a medical facility.
  2. The medical institution registers the ELN in the FSIS UIIS “Sotsstrakh”.
  3. The medical institution receives an ELN number from the FSIS UIIS “Sotsstrakh”.
  4. The medical institution provides the employee with the ELN number.
  5. Upon completion of the illness, the employee transfers the personal identification number to the accounting department of the organization in which he works. In this case, the employee fills out an application to the Social Insurance Fund with a request to pay the benefit, indicating the details for transferring funds.
  6. The employer downloads the ENL by number from the FSIS UIIS "Sotsstrakh" (ELN is filled in in the part supplied from the medical institution), fills out its part of the ENL with information about the employee's insurance experience and data on average earnings and makes the calculation.
  7. The employer pays the employee (if necessary) for the first three days of illness.
  8. The employer submits to the FSS a register of information about ELN downloaded from the FSIS UIIS “Sotsstrakh”, supplemented by information about the employees’ length of service and data for calculating benefits, a register of information for calculating benefits for direct payments and an employee’s application to transfer funds to the account of the insured person.
  9. FSS receives ELN from FSIS UIIS "Sotsstrakh".
  10. The FSS checks the information received and informs the employer of either an error log or confirmation of receipt of the register and application.
  11. Having confirmed receipt of the register, the Social Insurance Fund transfers to the employee part of the benefit in addition to the payment for the first three days.

Electronic and paper sick leave are legally equivalent documents.
With the introduction of electronic document flow between the medical institution, the employer and the Social Insurance Fund, personnel officers and accountants still need to fill out their part of the certificate of incapacity for work. User requests

The current legislation of the Russian Federation applies to this Privacy Policy and the relationship between the User and the Operator.

Users have the right to send their requests to the Operator, including requests regarding the use of their personal data, sending the withdrawal of consent to the processing of personal data in writing to the address specified in the General Provisions section of this provision, or in the form of an electronic document signed with a qualified electronic signature in accordance with legislation of the Russian Federation, and sent to contacts for feedback.

The request sent by the User must comply with the requirements established by the Rules for submitting requests to the Service and Support Service, namely contain:

  • number of the main identification document of the user or his representative;
  • information about the date of issue of the specified document and the issuing authority;
  • information confirming the user’s participation in relations with the Operator (in particular, the serial number of the user id or a short (subdomain) name that replaces the serial number id (if such is provided for by the functionality of the website));
  • signature of the User or his representative;
  • E-mail address;
  • contact number.

The Operator undertakes to consider and send a response to the User’s request within 30 days from the date of receipt of the request.

How to pay benefits

The procedure for paying benefits does not differ from the usual one. If the employer is located in a region where the pilot project has not yet been introduced, then within 10 working days he is obliged to assign a benefit to the employee and pay it on the next day of payment of wages.

If the employer is a participant in the pilot project, then he independently pays benefits for the first 3 days of sick leave, and the Social Insurance Fund pays the remaining days directly to the employee within 10 days after receipt from the policyholder.
