How does the 6-special form differ from the 6 form?

The waybill for a non-public bus is used for accounting of irregular bus passenger transportation. For example, this is relevant when it is necessary to transport enterprise employees from the gathering place to their workplaces, for travel within the enterprise, or for delivering workers to the site. In all these cases, it is advisable to use a service bus. Form 6 differs from form 6-special:

  1. Duration of validity: Form 6 has a longer period of use, in contrast to Form 6-special, designed for 1 working day or driver shift.
  2. Appointment. Form 6 is used for regular buses on city and suburban routes, and form 6-special is used on irregular flights for the internal needs of the company (for transporting goods owned by the company or for transporting employees).
  3. The number of orders in one voucher. Form 6 has no restrictions of this kind, while Form 6-special is intended for the implementation of tasks assigned by one or a maximum of two customers.

Order of conduct

The inspector monitors the technical condition of the vehicle before leaving for a trip, at which point the following are tested:

  • ability to operate the braking system;
  • reliability of interaction between the steering wheel and the steering knuckles;
  • windshield washers;
  • integrity of wheels and tires (for all vehicles except trams);
  • horn performance;
  • tachograph;
  • reliability of satellite navigation (do the online maps necessary for movement work);
  • functioning of the communication system with emergency services;
  • serviceability of door locks, gas tank caps;
  • reliable fixation of the driver's seat;
  • devices responsible for heating and blowing glass;
  • integrity of parts intended for towing (tow bar, chains and cables);
  • holders on which the spare wheel is fixed (for all vehicles except trams);
  • operability of transport position clamps for semi-trailer supports (if included in the configuration).

The controller also checks:

  • does the instrument panel indicate the presence of faults that may impede safe movement on the road (for this purpose the vehicle is started);
  • quality of view from the driver's seat;
  • reliable fixation of rear view mirrors;
  • serviceability of the suspension, aprons to protect against dirt and mudguards;
  • operability of safety belts and head restraints on seats.

Passage stamp - sample and types

The pre-trip technical inspection stamp is used to place a mark on the passage of PTOTS or pre-shift control on the waybill. The prototype of the tag was approved by Order of the Ministry of Transport No. 296 of 08.08.2018.

Requirements for the controller

In what cases can the transportation of cargo and passengers be considered commercial?

According to Federal Law No. 259 of November 8, 2007, commercial transportation includes services for the transportation of goods, luggage and passengers.

Also, according to the same law, such concepts as cargo, luggage and passengers are clarified, namely:

Cargo is a material object accepted for transportation in the prescribed manner.

Baggage is a passenger’s belongings accepted for transportation in the prescribed manner.

Passenger is an individual who has entered into an agreement for the carriage of a passenger, or an individual for the purpose of whose transportation a vehicle charter agreement has been concluded.

Also pay your attention to Article 2 “Basic concepts used in this Federal Law No. 259”, which specifically explains what a carrier is:

  • Carrier is a legal entity, individual entrepreneur who, under a contract for the carriage of passengers, a contract for the carriage of cargo, has assumed the obligation to transport the passenger and deliver luggage, as well as to transport the cargo entrusted by the shipper to the destination and hand over the luggage and cargo to the person authorized to receive them.”

So what follows from this:

New rules for filling out Travel Sheets from 2021

From February 26, 2021, the mandatory details of travel sheets that are developed independently include:

  1. Title - waybill;
  2. Number;
  3. Validity;
  4. Information about the owner of the car;
  5. Machine type and model;
  6. State registration plate of the car;
  7. Odometer readings when leaving the garage and when entering the garage;
  8. Date and time of leaving the garage and entering the garage;
  9. Signature and full name an employee who enters the odometer readings, date and time on the sheet;
  10. FULL NAME. driver;
  11. Date and time of pre-trip and post-trip medical examination of the driver;
  12. Stamp, signature and full name. a medical professional who conducts a medical examination;
  13. A note on the pre-trip inspection of the technical condition of the vehicle with date and time;
  14. Signature and full name controller of the technical condition of the machine.

Why don’t traffic police officers have the right to demand a waybill and a power of attorney from drivers?

And so, friends, let's carefully look at paragraph 2.1.1 of the Rules of the Road.

According to clause 2.1.1 of the Russian Federation Traffic Regulations, the driver of a motor vehicle is required to carry with him and submit upon request to police officers (including traffic police officers of the State Traffic Safety Inspectorate of the Russian Federation) for verification the following documents:

— a driver’s license or temporary permit to drive a vehicle of the appropriate category or subcategory;

- registration documents for this vehicle (except for mopeds), and if there is a trailer - also for the trailer (except for trailers for mopeds);

- in established cases, permission to carry out activities for the transportation of passengers and luggage by passenger taxi, waybill, license card and documents for the transported cargo, and when transporting large, heavy and dangerous goods - documents provided for by the rules for the transportation of these goods;

- a document confirming the fact of disability, in the case of driving a vehicle on which the identification sign “Disabled” is installed;

— insurance policy of compulsory insurance of civil liability of the owner (MTPL policy);

- in cases directly provided for by the legislation of the Russian Federation, have and submit for verification to employees of the Federal Service for Supervision of Transport an access card for a vehicle for international road transport, a waybill and documents for the transported cargo, special permits, if available in accordance with with the legislation on highways and road activities, it is allowed to drive heavy and (or) large-sized vehicles on highways, a vehicle transporting dangerous goods, and also provide a vehicle for weight and dimensional control.

Please, friends, draw your attention to the text highlighted in red. This paragraph tells us that drivers are required to carry a waybill with them only in cases established by law. That is, if you follow the logic of the law, the driver does not always have to carry a waybill with him. Otherwise there would not have been Fr. in the law.

Also, let's read clause 2.1.1 carefully. SDA-

-Do you see a clause here obliging the driver to carry with him and present to the police upon request a power of attorney? Naturally, this clause is not here, since in the current traffic rules this legal requirement was abolished by the Decree of the Government of the Russian Federation back in 2012.

And so, according to the traffic rules that are in force today, no one has the right to demand from you a power of attorney for the right to drive a vehicle, even regardless of who owns the car.

Please remember that a power of attorney is needed only if the driver intends to carry out any legal actions on behalf of a legal entity or entrepreneur. For example, picking up a car from a parking lot or carrying out registration actions at the traffic police.

You and I also know that you need to carry a completed waybill with you only in cases established by law.

But in what cases, established by law, are drivers required to carry a completed waybill with them and present it at the request of the police?

Yes, indeed, in certain cases, you still need to fill out a waybill and take it with you in order to present it upon request. For example, in cases where the driver is engaged in the commercial transportation of cargo(s) or passengers.

First, let's find out, friends, in what cases the waybill is filled out. This issue is regulated by Order of the Ministry of Transport of the Russian Federation No. 152 of September 18, 2008, “On approval of mandatory details and the procedure for filling out waybills,” as amended for 2021.

So, according to this document, the waybill is filled out for vehicles owned by legal entities or individual entrepreneurs for the transportation of goods, passengers or luggage. Here is an excerpt from Order of the Ministry of Transport No. 152:

  • clause 9. A waybill is issued for each vehicle used by a legal entity, individual entrepreneur for the transportation of goods, passengers and luggage by road and urban ground electric transport in urban, suburban and intercity traffic.”

Many of you will say that this document does not contain a word about “commercial transportation” and therefore, and apparently, this waybill must be issued in all cases of operation of a vehicle that belongs to a legal entity or individual entrepreneur.

Actually this is not true. The fact is that this Order of the Ministry of Transport No. 152 directly refers to a more important one, i.e. The federal law:

Law No. 259-FZ “Charter of road transport and urban ground electric transport” of November 8, 2007

Article 1. Subject of regulation.

  1. This Federal Law regulates relations arising in the provision of services by road transport and urban ground electric transport, which are part of the transport system of the Russian Federation. Relations related to the provision of services by road transport and urban ground electric transport and not regulated by this Federal Law are regulated by other federal laws and other regulatory legal acts of the Russian Federation.
  1. This Federal Law determines the general conditions for the transportation of passengers and luggage, cargo, respectively, by buses, trams, trolleybuses, cars, trucks, including the use of car trailers, car semi-trailers (hereinafter also referred to as vehicles), as well as the general conditions for the provision of services to passengers , charterers, shippers, consignees, carriers, charterers at transport infrastructure facilities.
  1. Transportation of passengers, baggage, and cargo by road in international traffic is regulated by international treaties of the Russian Federation.
  1. The provisions of the legislation of the Russian Federation on the protection of consumer rights also apply to relations related to the transportation of passengers and baggage, cargo for personal, family, household or other needs not related to business activities.

That is, as you can see, gentlemen, Order of the Ministry of Transport No. 152, referring to Federal Law No. 259, implies that a waybill must be issued for commercial transportation of goods and passengers. But in these documents there is not a word that the driver of a car that belongs to a legal entity or individual entrepreneur must have a completed waybill in hand for any type of transportation. That is, if there is no fact of commercial transportation in accordance with the order of the Ministry of Transport, the waybill should not be filled out. For example, when traveling for corporate needs of the company. Otherwise, this would be spelled out in such a document.

Who can conduct

The company managing transportation can hire a controller or implement control in a third-party service center. In any of the options, only a professional qualified specialist has the right to provide car inspection services. An auto mechanic must meet a number of necessary requirements, which will be discussed below.

Important. Any company employee with a secondary specialized education can undergo professional retraining to qualify as a controller.

Voucher without a doctor's note

A document filled out according to the established rules, but without a mark and stamp indicating a completed medical examination, is considered valid. When conducting an on-site or desk audit, tax officials recognize the travel expenses incurred for such a voucher. But the traffic police officers will fine you (comment in part 2 of article 12.31.1 of the Code of Administrative Offenses of the Russian Federation):

  • driver - 3,000 rubles;
  • manager or head of the transport department - 5,000 rubles;
  • legal entity - 30,000 rubles.

If a budget organization uses a false stamp to confirm a driver’s medical examination or illegally violates the established procedure, Article 11.32 of the Code of Administrative Offenses provides for fines:

  • per driver - from 1000 to 1500 rubles;
  • for the manager or responsible person who allowed the use of a false stamp - from 2000 to 3000 rubles;
  • for organization - from 30,000 to 50,000 rubles.

Registration and accounting

This journal is usually managed by a secretary or other employee close to the management of the enterprise. Here it is enough to make a note about the name of the order, its number and date of issue. If necessary, the journal will help verify the very fact of creating an order, as well as easily and quickly find it.

As such, there are no strict regulations on the procedure for issuing and recording the movement of letters. Pre-trip inspections are carried out on the basis of the Federal Law. Various forms of ownership, number of vehicles, limited staff dictate their method of issuing and monitoring the movement of documents. Vouchers can be issued by any employee who has been assigned to do this.

Large transport organizations are introducing the position of dispatcher. In others, this may be undertaken by an accountant or the director of the company himself. The new law of the Ministry of Transport No. 152 does not directly indicate mandatory journal keeping. It specifies an industry-level journal. But it is better to have a book where you can track the dates of receipt of sheets in the accounting department, how much time it takes to process them.

The journal form is available in the editorial office of Goskomstat No. 78, you can use it. How to control primary documents, who receives them and when, transfers them to other employees, processes, stores and accounts for them, is prescribed in the “Accounting Policy”. It would not be superfluous to include the responsibilities for filling out and submitting vouchers in the job descriptions of those employees to whom you are going to entrust this.
