The minimum wage (SMW) increased in 2021 and is now calculated according to new rules. What minimum wage should you target from 01/01/2021? In what calculations should it be used? Minimum wage 2021: law

The minimum wage in 2021 depends on the cost of living for the working population in the second quarter of 2021. The Ministry of Labor approved the living wage per capita for the second quarter of 2021. The cost of living is:

The minimum wage in Moscow is 20,361.00 rubles. At the same time, the federal minimum wage is 12,130.00 rubles.

As can be seen in the screenshot, the new minimum wage in the capital is equal to the subsistence minimum for the working population of Moscow.

The Chelyabinsk and Yaroslavl regions look in contrast to Moscow:

  • in the Chelyabinsk region there is a federal minimum wage of 12,130.00 rubles,
  • The Yaroslavl region has established a minimum wage, but in the same amount as the federal minimum wage.

The establishment of a minimum wage in the Yaroslavl region, instead of the minimum wage, is indicated by the 3rd column.

In particular, it indicates the Regional Agreement on the Minimum Wage for 2021 - 2021 dated December 29, 2017.

This agreement replaces the minimum wage with the minimum wage in the region, but their size is the same.

Which minimum wage should we focus on: federal or regional?

In a subject of the Russian Federation, in accordance with the agreement of such a subject, a regional minimum wage may be introduced (Article 133.1 of the Labor Code of the Russian Federation). It applies to employees in the relevant region, except for those who work in organizations financed from the federal budget and those whose employers have followed a special procedure for refusing to join the regional minimum wage.

The minimum wage established in the region of the Russian Federation cannot be less than the federal minimum wage. That is, in no region of Russia from January 1, 2021, the minimum wage can be less than 12,130 rubles.

However, it is worth saying that in cases where the regional minimum wage in a constituent entity of the Russian Federation is not approved, the minimum wage established by federal legislation is applied.

When to apply it is necessary to apply the federal minimum wage (RUB 12,130)

Employers must use the federal minimum wage when calculating wages, vacation pay, travel allowances and other payments that are calculated from average earnings. The minimum wage also affects three benefits: sick leave, maternity leave, and child care benefits up to 1.5 years.

When to apply regional minimum wages

In 2021, employers are required to apply regional minimum wages if they have joined the regional agreement.

Let us remind you that employers who, within 30 calendar days after publication of the agreement, have not sent a written reasoned refusal to accede to the document to the labor authority of a constituent entity of the Russian Federation will automatically join the regional agreement. If the employer sent such a refusal, then you can rely on the federal minimum wage. If the refusal is not sent, then the employer is obliged to comply with the provisions of the regional agreement.

From January 2021, the minimum wage is 12,130 rubles.

According to the law, employee wages should not be less than the minimum wage and industry minimums. If this rule is violated, the company is obliged to pay a fine of up to 50,000 rubles.

Turning to the Labor Code of the Russian Federation, we note the following: since 2002, a law has come into force stating that the minimum wage should not be lower than the subsistence level. However, let us pay attention to the addition, which states: an increase in the minimum wage must be established by a separate federal law. Let us note that it appeared in 2021, and before its appearance there were only statements of intentions to increase the federal minimum wage to the subsistence level.

Regional coefficient

In addition to the basic salary, taking into account the Labor Code of the Russian Federation and the minimum wage, there is a regional coefficient - an increase in the employee’s salary. It is calculated based on climatic conditions and area of ​​activity (i.e. industry).

So, for example, employees of the Far North, in addition to the basic salary, which must also be no less than the minimum wage, receive an additional salary increase - the so-called “ northern ”.

When calculating wages for such employees, it is necessary to use the minimum wage, increased by the required allowance.

Salary from 2021

If the employee performs his or her job duties efficiently within a month, the employee must receive a salary of at least the minimum wage. There are 3 meanings:

  • federal;
  • regional;
  • industry minimum wage.

At the federal level (RF), an employee’s salary from January 2021 must be at least 12,792 rubles.

If you are an employer, then you have 2 ways to increase an employee’s salary, following the new minimum wage from 01/01/2021:

  1. The manager can increase the salary . To do this, it is necessary to issue a new increase order, change employment contracts and other documents indicating the salary amount.
  2. A less labor-intensive way is to introduce a surcharge . Thus, in local acts it is only necessary to establish the amount of this additional payment, since the minimum wage does not include salary, but the entire salary in total - salary and other additional payments.

Thus, when an employee, taking into account the total working time, has worked all the days of his schedule for a month, he will receive an amount not less than the minimum wage. If his salary meets or exceeds the established minimum wage, there is no need for additional payment.

What's coming from 2021

Let's move on to the changes that await us in 2021.

The President of the Russian Federation signed Federal Law No. 473-FZ dated December 29, 2020, changing the procedure for determining the minimum wage. Now the determining indicator for calculating the minimum wage starting from 2021 is not the cost of living, but the median salary in the country.

Calculates the median value for the Rosstat minimum wage adjustment. In 2021, the minimum wage is 42% of the value calculated by Rosstat - 12,792 rubles.

At the same time, the link between the minimum wage and various types of benefits, social payments and the minimum acceptable wage has been preserved.
