New minimum wage from January 1, 2021: table for all regions


From January 1, 2021, the minimum wage is 11,280 rubles (+1.05%) (Order of the Ministry of Labor dated August 24, 2018 No. 550n).

From May 1, 2021, the minimum wage is 11,163 rubles (+17.6%), i.e. equal to the federal subsistence minimum for workers (Federal Law dated 03/07/2018 No. 41-FZ)

The coefficient and percentage bonus for work in the Far North and equivalent areas are calculated above the minimum wage, and are not included in it.

From January 1, 2021, the minimum wage was 9,489 rubles.

New federal minimum wage from 2021: new amount

According to Article 1 of the law on the minimum wage (dated June 19, 2000 No. 82-FZ), from January 1, 2021, the minimum wage is fixed by federal law in the amount of the subsistence level of the working population in Russia as a whole for the second quarter of the previous year.

Order of the Ministry of Labor and Social Protection of the Russian Federation dated August 24, 2018 No. 550n determined the living wage for Russia as a whole for the second quarter of 2021. The order sets the cost of living for the second quarter of 2018 on average per capita at 10,444 rubles. Living wage:

  • for the working population is determined in the amount of 11,280 rubles;
  • for pensioners – 8,583 rubles;
  • for children – 10,390 rubles.

This means that in 2021 the minimum wage for the working population will be 11,280 rubles.

Note that from May 1, 2021, the minimum wage was 11,163 rubles per month. It turns out that from January 1, 2021 it will increase by only 1%. (up to RUB 11,280). Only 117 rubles.

Goals

The minimum wage appeared in the world as a tool to protect workers who were exploited in factories and factories, forced to work 18 hours a day for tiny money. Although these times are far in the past, the need for a minimum level remains.

For our country, the minimum wage plays an important role, since we have an acute problem of the poor population. For example, in the second quarter of 2019, the share of the poor population was 18.6 million people, that is, 12.7% of the total population of the country. The poor include those citizens whose incomes are below the subsistence level.

With an increase in the minimum wage, there is a possibility that a certain proportion of citizens will be able to rise above the poverty line. Although, it should be noted that the change of status will be generally formal, since a few hundred extra rubles will not radically change the life of a poor person. Perhaps, as before, he will have to regularly borrow money from friends or contact a microfinance organization to take out an urgent microloan.

Regional minimum wages cannot be less than 11,280 rubles

Minimum wage values ​​are fixed at the federal and regional levels. As we have already said, at the federal level in Russia the minimum wage from January 1, 2021 is 11,280 rubles.

However, each region must also have its own minimum wage. It is established by the constituent entities of the Russian Federation through regional agreements on the minimum wage. The regional minimum wage is usually higher than the federal one. But it cannot be less! (Article 133.1 of the Labor Code).

Organizations must set wages no less than the regional minimum wage if they have joined regional agreements. “By default”, those employers who, within 30 calendar days after the official publication of the agreement, have not sent a written reasoned refusal to join to the labor authority of a constituent entity of the Russian Federation, join the regional agreement. If such a refusal occurred, then compare salaries with the federal minimum wage. If the refusal was not sent, rely on the regional minimum wage (Part 8 of Article 133.1 of the Labor Code).

If in the constituent entity of the Russian Federation in which the employer operates, a special agreement has established the size of the regional minimum wage, then the salary of employees should not be less than this amount (Article 133.1 of the Labor Code of the Russian Federation). However, if the employer does not want to join this agreement, then he has the right to issue a written refusal to join. Those who did not write such a refusal are considered to have automatically joined the regional agreement. Consequently, if they pay wages below the regional minimum wage, these employers face the same sanctions as if they pay wages below the federal minimum wage.

What does the minimum wage affect?

The change in the minimum wage will affect some indicators that are determined on the basis of the minimum wage. It must be remembered that various penalties have long been “detached” from the minimum wage and are indicated in fixed amounts.

Wage

From January 1, it will be necessary for all employees whose salary is less than the established value to increase it at least to its size.

If this step is not taken, then if a violation is detected, the organization will be subject to a fine of 50,000 rubles.

If such a violation is detected again in the future, the amount of the fine will be doubled. If the requirements of the law regarding the establishment of the minimum wage are further ignored, a criminal case may be opened against the management of the business entity.

Attention: an employee’s earnings may legally be less than the minimum wage as of 01/01/2019. This may happen if his employment agreement specifies part-time employment conditions, or he is employed part-time by the company.

Such assumptions are due to the fact that, under these working conditions, the required standard hours cannot be fully worked out within a month.

The law gives the right to subjects of the country to determine a separate minimum wage indicator for their region. It cannot be lower than the federal level, and the business entity must comply with it.

Attention: in order to prevent violations, it is necessary to first clarify the current minimum wage in a specific region of the country.

In order to comply with the requirements of the law regarding compliance with the established minimum wage, the following actions must be taken:

  1. Issue an order to increase wages;
  2. Draw up and sign additional agreements with each employee whose salary is less than the established minimum wage;
  3. Change the current staffing schedule or introduce a new one.

Benefits

The next increase in the minimum wage will have a direct impact on the amount of benefits that are due to employees and unemployed citizens when applying for sick leave, as well as in the case of maternity leave.

This change is due to the fact that the minimum possible benefit amount is calculated on the basis of the minimum wage.

The minimum benefit must be paid to the employee in the following situation:

  • During the period of time that is used to determine the amount of benefits, the employee had no accruals at all, or their amount was less than the established minimum wage.
  • The employee has less than six months of work experience;
  • The employee who issued the sick leave was found to have violated the sick leave regime.

Attention: due to the increase in the minimum wage, the minimum daily earnings from January 1 will be 370.85 rubles.

When can a salary be less than the minimum wage?

Sometimes the salary may be less than the minimum wage after January 1, 2021, since the salary includes not only the salary itself, but also compensation payments (for example, various allowances for working conditions), as well as incentive payments (for example, bonuses) (Art. 129 of the Labor Code of the Russian Federation). Therefore, if in a month an employee receives, taking into account all allowances and incentives, an amount greater than or equal to the minimum wage, then this is quite normal.

If, after deducting personal income tax, from the income due to the employee, he receives an amount less than the minimum wage (RUB 11,280), then this is normal.

Keep in mind: do not include bonuses for work in the Far North and the regional coefficient in the amount of the salary that you compare with the minimum wage. Accrue these payments on top of your salary. That is, the salary should be no less than the regional or sectoral minimum wage, without the regional coefficient and the “northern bonus.”

Part-time work, days at your own expense, sick leave

Partial day or week . If an employee works part-time or part-time, then his salary may also be lower than the minimum wage, but strictly in proportion to the time worked. If a specialist works part-time, then his earnings must be at least 0.5 minimum wage.

Part-time job . By law, a part-time worker cannot be employed in each of his two jobs more than 50% of the time. Therefore, a part-time worker cannot be paid less than 0.5 minimum wage per month.

Sick leave . If the employee was sick, the minimum wage may be less than the minimum wage. Because his earnings are calculated based on days worked + compensation for incapacity for work.

Vacation at your own expense . In this case, the salary may also be lower than the minimum wage, because The specialist worked for less than a month.

Contract, non-standard cooperation or GPC agreement . It is possible that the employee is non-staff. This could be, for example, a freelancer hired for a short-term project under a GPC agreement, or an individual entrepreneur working as a subcontractor. In this case, there is no employment relationship between such a specialist and the organization, and payment is made in accordance with the concluded contracts.

Minimum wage and unemployment benefits

In 2021, due to the coronavirus pandemic, the maximum amount of unemployment benefits was equalized to the minimum federal wage (RUB 12,130). By Government Decree No. 2393 of December 31, 2020, this figure was maintained. But this is the minimum level approved throughout the country. And in the capital they decided that they had to pay an additional 850 rubles to this amount. and additionally compensate for transportation costs (RUB 1,450). As a result, some unemployed Muscovites receive 14,430 rubles in 2021. How to properly increase wages to the new minimum wage in the regions

Situation abroad

The minimum wage in European countries is much higher than the Russian level. For example, in Germany the minimum wage is around 1600 euros, in France it is 1520 euros. Spaniards will not be able to work with wages below 1,000 euros. For residents of Greece, the minimum salary starts at 758 euros.

In some countries of the world, they do not use a monthly rate, preferring to set the minimum wage for 1 hour of working time. Possible fines

For wages below the minimum wage, fines are imposed without proper justification.
The company, if the violation is the first, faces a fine from 30,000 to 50,000 rubles. If the violation is repeated – from 50,000 to 70,000 rubles. For an official, the sanctions are accordingly: a fine from 1000 to 5000 rubles. and from 10,000 to 20,000 rubles. or disqualification from one to three years. Specific figures for wages

The notorious 72% of the minimum wage became such only in 2017. The federal value of such payment is fixed at 7,800 rubles. There has been a fairly modest increase in size in 2021 due to the economic crisis.


For example, it is worth considering the increase in wages in 2016-2017 relative to the federal level:

  1. Since January 2021, the minimum wage has been set at 6204 rubles. according to No. 376-FZ dated December 14, 2015.

The difference in the percentage increase in the minimum wage is obvious. It will become even more expressive when the bill on the gradual equalization of wages and the living wage comes into force. Starting in January 2021, it is planned to establish a minimum wage of 9,489 rubles; the increase will be 21.65%, bringing wages to 85% of the subsistence level.

This is data at the federal level, with the exception of both capitals and their regions. You also need to know that for the northern regions there is an increasing coefficient that directly increases wages. Most Russians also need to understand that other minimum wage values ​​for Moscow, St. Petersburg and their regions are not associated with the whim of officials, but with the higher “cost” of living in these regions.

The first 2 readings of the bill on equalizing the minimum living wage and wages took place as planned in November 2017. At the first reading during the State Duma meeting on November 8, the bill passed further. Already on November 17, 2021, during the meeting, it was planned to allocate 4.4 billion rubles to increase wages for budget employees. Growth rates varied greatly in different years - from 1 to 20.89%. This depended on various reasons - the size of inflation, the index of rising prices for products, goods and services, the economic situation in the country, the financial possibility of indexation.

Basic provisions on wages and their minimum amount

The minimum wage (this is what the abbreviation of this value looks like) can be regional and federal. This value applies:

  • to set wages in 2021;
  • definitions of basic benefits: for pregnancy, childbirth and unemployment;
  • to achieve the goals of compulsory health insurance.

The minimum wage for labor is described in Article 133 of the Labor Code. It states that:

  • The minimum wage is established throughout the country at the same time, and its size is determined by federal law;
  • paid from the budget (for state enterprises) or from the employer’s funds;
  • remuneration below this level is impossible, the employee has completed all the labor tasks assigned to him for the month.

There is another interesting point in Article 133. According to it, the minimum wage level cannot be lower than the subsistence level. However, today it does not work, since the code contains Article 421, which makes it possible to regulate the gradual increase in wages by federal laws. Currently, active work is underway to equalize two values ​​– the subsistence minimum and the minimum wage. Today there is still a significant difference between them. However, even in conditions of a deficit budget, the minimum amount for labor is growing.

Subjects of the federation are allowed to set their own level of remuneration. According to the law, the authorities can only assign an amount that exceeds the minimum wage, that is, after the local agreement comes into force, it must exceed that established throughout the country. A region that wants to improve the living conditions of its residents enters into a special agreement between the heads of enterprises. If it is accepted, then employers in the territory of the subject do not have the right to pay less than the accepted minimum wage threshold.

Supplement to the minimum salary

The state provides additional payments to the minimum wage due to unfavorable climatic conditions. The minimum wage is considered to be the legally valid “minimum wage” multiplied by the coefficient established for a specific region.

The need for adjustment is specified in the employment contract with the employee and applied to the wage fund. The exception is payments that are calculated based on average earnings.

These include:

  • vacation pay;
  • compensation for unused vacation;
  • benefits for temporary disability at the expense of the enterprise and the social insurance fund;
  • payment for additional days off in connection with donation;
  • average salary during a business trip;
  • remunerations based on the results of work for the quarter and year, which are of a one-time nature;
  • compensation payments for downtime.

Legislative justification - when calculating the average daily wage in the previous period, additional payments and allowances to the minimum wage are already included.

Regional coefficients

The Labor Code of the Russian Federation establishes territories in which enterprises and individuals with hired workers are required to adjust wages by established increasing factors.

These include areas:

  • Far North;
  • alpine;
  • deserts;
  • anhydrous.

If a region falls under the influence of several allowances for employees, the maximum percentage is selected. In 2021, the minimum coefficient was 1.15, the maximum – 2. The maximum permissible maximum premium is established for residents of the territories:

  • Sakhalin Islands;
  • Kamchatka Peninsula;
  • Chukotka Autonomous Okrug;
  • Republic of Sakha (Yakut Autonomous Okrug);
  • islands located in the Arctic Ocean.

A number of districts of the Murmansk region and Krasnoyarsk Territory have a coefficient of 1.8. The values ​​of increasing coefficients are published annually in the media and on the official websites of the fiscal service.

Northern surcharges

Persons working in the Far North and equivalent territories, in addition to the bonus taking into account the regional coefficient, receive northern additional payments, depending on the following factors:

  • length of residence in the region;
  • biological age of the person;
  • total work experience in the Far North or equivalent territory.

For every six months of work in the region, a bonus of 10% is awarded until reaching 100% - the maximum northern surcharge paid exclusively in the Far North. In equal territories, the maximum premium is 50%.

The size of the minimum wage in the regions of the country depends on climatic and economic factors.

Compliance with the legally established indicator is the responsibility of enterprises, regardless of the form of ownership, and individual entrepreneurs using hired labor. 2018 put an equal sign between the minimum wage and the subsistence minimum, eliminating the legislative discrepancy.
