The conditions for receiving a discount on the injury rate have been clarified


Introductory information

Insurance premiums for injuries are paid by those organizations and individual entrepreneurs that have employees (regardless of the taxation regime). Contributions are calculated based on the insurance tariff, taking into account a discount or premium (clause 1, article 22 of the Federal Law of July 24, 1998 No. 125-FZ “On compulsory social insurance against industrial accidents and occupational diseases”). The maximum possible discount is 40% of the tariff. The discounted rate is determined by the following formula:

Tariff set for the employer for the current year = Tariff corresponding to the main type of activity of the company for the current year × (100% discount)

Let us explain the application of the formula. Let's say the policyholder is engaged in the retail trade of alcoholic beverages (OKVED code 52.25). This type of activity is equated to the first class of professional risk (Order of the Ministry of Labor of Russia dated December 25, 2012 No. 625n). The rate of contributions for injuries for this class is minimal and amounts to 0.2% (Article 1 of the Federal Law of December 22, 2005 No. 179-FZ). If the policyholder receives the maximum discount (40%), then the tariff will decrease to 0.12% (0.2 × (100% - 40%)). The same approach will be applied to other tariffs (from 0.2% to 8.5% of the amount of payments and benefits accrued to employees).

As you can see, the insurance rate depends on the main type of activity of the organization or individual entrepreneur (the more dangerous the activity, the higher the rate will be).

The main activity is the type of activity from which the organization, based on the results of the previous year, has the largest share in total revenue (excluding VAT). The main type of activity of an individual entrepreneur is determined on the basis of the Unified State Register of Individual Entrepreneurs (clauses 9, 10 of the Rules, approved by Decree of the Government of the Russian Federation of December 1, 2005 No. 713).

Now policyholders have the opportunity to receive a discount on injury premiums for 2015. To do this, you need to contact the FSS before November 1, 2014. If the discount is agreed upon, then you will be able to pay less next year.

What's happened?

The Russian Social Insurance Fund (FSS) reminded all employers of the need to submit an application for a reduction in insurance contributions against industrial accidents and injuries in 2021. Many employers are entitled to a discount of up to 40%, but this can only be provided to them upon application. The amount of insurance premiums that employers pay monthly is not uniform; it depends on the insurance tariff established by the Social Insurance Fund. That is why it can be significantly reduced.

Who can qualify for a discount?

Any policyholder can receive a discount for 2015 if five conditions are simultaneously met (clauses 4, 5, 8 of the Rules approved by Decree of the Government of the Russian Federation of May 30, 2012 No. 524, hereinafter referred to as Rules No. 524). Let's present them in table form:

1. At least three years must pass from the date of state registration to the year in which the discount is calculated. Accordingly, if the discount is calculated in 2014, then the organization must have existed since 2010 or earlier.
2. The policyholder must pay current injury insurance premiums on time. This requirement applies to the year the application for the discount was submitted (Determination of the Supreme Arbitration Court of the Russian Federation dated January 23, 2014 No. VAS-19460/13). That is, to receive a discount for 2015, there should be no delays in paying contributions in 2014.
3. As of the date of filing the application, there must be no arrears of past injury contributions. For example, there should be no debts for 2012 or 2013.
4. In the previous year (2013), the policyholder should not have had any fatal industrial accidents.
5. As of January 1, 2014, workplace certification and mandatory medical examinations must be carried out.

What happens if information is not submitted to the FSS of Russia?

It happens that the required information is not provided within the deadline of April 15. In this case, the fund independently determines the employer’s main activity for the current year.

The main activity is recognized as the activity of the employer, which corresponds to the highest class of professional risk. At the same time, the fund does not have the right to choose the most “risky” type of business arbitrarily from all types of activities declared by the organization upon registration. In making the determination, the fund must take into account only those activities in which the organization was actually engaged in the previous year. This follows from paragraph 13 of the Rules, approved by Decree of the Government of the Russian Federation dated December 1, 2005 No. 713, and is confirmed by Resolution of the Presidium of the Supreme Arbitration Court of the Russian Federation dated July 5, 2011 No. 14943/10 and the ruling of the Supreme Court of the Russian Federation dated June 30, 2015 No. 301- KG15-6612.

Moreover, if the actual type of activity differs from the declared one, the fund must return to the organization the insurance premiums paid at a higher rate. This is indicated by the judges in the ruling of the Supreme Court of the Russian Federation dated September 2, 2015 No. 303-KG15-10066.

Documents for receiving a discount

If the listed conditions are met, to receive a discount you need to contact your territorial branch of the Social Insurance Fund and submit an application in the prescribed form (Appendix No. 5 to Order of the Ministry of Labor of Russia dated September 6, 2012 No. 177n). The application will need to indicate, in particular, the OKVED code that corresponds to the main activity of the policyholder.

You can send an application to the FSS:

  • in paper form;
  • in the form of an electronic document signed with an enhanced qualified electronic signature (clause 21 of the Administrative Regulations, approved by order of the Ministry of Labor of Russia dated September 6, 2012 No. 177n, hereinafter referred to as the Regulations).

There is no need to submit other documents. They will take the information necessary for FSS specialists to establish a discount from the previously submitted calculation by the policyholder in Form 4-FSS. After all, information about medical examinations and certification performed as of January 1, 2014 is reflected in table 10 of section II of FSS Form-4, which is submitted by all policyholders.

Starting with reporting for the first quarter of 2014, Table 10 of Section II of Form-4 of the FSS must reflect data on a special assessment of working conditions, as well as on mandatory preliminary and periodic medical examinations performed at the beginning of the year. However, if the validity period of certification of workplaces for working conditions has not expired and a special assessment has not been carried out, information about the certification of workplaces is entered into the table (paragraph 2 of clause 34.1 of the Procedure for filling out Form-4 of the FSS, approved by Order of the Ministry of Labor of Russia dated March 19, 2013 No. 107n). Tariff for those who have just registered

For a newly created organization (entrepreneur), the tariff is set by the territorial branch of the Federal Social Insurance Fund of Russia in which it is registered. There is no need to submit any additional information to the fund.

The main type of activity of the organization (entrepreneur) will be determined by the fund’s employees based on the information available in the Unified State Register of Legal Entities (USRIP). More precisely, it will be considered the species that is first on the list of all declared ones.

Organizations name the planned types of activities in sheet “I” of the application in form No. P11001, which is submitted for registration. And entrepreneurs - in sheet “A” of the application in form No. P21001. Both forms were approved by order of the Federal Tax Service of Russia dated January 25, 2012 No. ММВ-7-6/25.

This follows from paragraph 10 of the Procedure approved by the FSS of Russia Resolution No. 27 of March 23, 2004, paragraph 2 of Article 6 of the Law of July 24, 1998 No. 125-FZ.

The assigned tariff will be communicated to the organization by the FSS of Russia in a notification. The form of this document is given in Appendix 3 to the Procedure approved by Resolution of the FSS of Russia dated March 23, 2004 No. 27.

Discount calculation method

The discount on contributions for injuries is calculated using a special methodology, which was approved by Order of the Ministry of Labor of Russia dated 01.08.12 No. 39n. For the calculation, indicators for the past three years are used, that is, 2011-2013.

In particular, the following values ​​will affect the calculation of the discount:

  • the ratio of the Social Insurance Fund's expenses for the payment of provisions for all insured events in the company and the total amount of accrued contributions for injuries;
  • number of insurance (accidents) cases per 1,000 employees;
  • number of days of temporary disability due to injury per accident.

Please note: figures are compared to industry averages. For 2015, they were approved by Resolution of the Federal Insurance Service of the Russian Federation dated May 30, 2014 No. 79. If at least one of the named indicators turns out to be more than the industry average for the policyholder, then he will not be given a discount. Moreover, if the indicators are higher, the policyholder will be assigned a premium to the tariff. If desired, the calculations of FSS specialists can be double-checked. For these purposes, after a decision has been made to establish (refuse to establish) a discount or premium, you can request from the Fund the data on the basis of which it was made (clause 11 of Rules No. 524).

What documents to submit to the FSS of Russia

Based on the calculations, fill out the documents that need to be submitted to the territorial branch of the FSS of Russia:

  • certificate confirming the main type of economic activity;
  • statement confirming the main type of economic activity.

Attach a copy of the explanatory note to the balance sheet for the previous year. It is not necessary to rent it out only to small businesses and entrepreneurs.

Submit the documents to the territorial branch of the FSS of Russia no later than April 15 of the year for which the tariff is set. These documents can be submitted on paper (in person or by mail). But the FSS of Russia recommends sending documents through a single portal of public services. Step-by-step instructions on how to do this are posted on the Russian FSS website.

This is provided for in paragraph 3 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55, paragraph 47 of the Administrative Regulations approved by order of the Ministry of Labor of Russia dated September 6, 2012 No. 178n and confirmed on the official website of the FSS of Russia.

In order to submit documents through the government services portal, the organization must have an enhanced qualified electronic signature on a physical medium. You can obtain it from one of the certification centers accredited by the Russian Ministry of Telecom and Mass Communications. In addition, a cryptoprovider program must be installed on the computer from which documents will be sent.

Result of consideration of the application

Discount

Employees of the Federal Social Insurance Fund of the Russian Federation must decide to establish a discount on the tariff no later than December 1 of the current (2014) year and inform the policyholder about this.

Surcharge

The amount of the premium is calculated by the FSS of the Russian Federation on its own initiative for each policyholder. That is, the premium is set by notification (without an application from the company). The premium is set no later than September 1 of the current year (clause 9 of Rules No. 524).

The discount (or surcharge) will need to be applied to those contributions that will be accrued for periods starting from 2015. That is, for the first time, you will need to pay contributions for injuries with a discount (surcharge) for January 2015 (clause 10 of Rules No. 524).

Tariff for separate divisions

If a separate division of an organization independently pays premiums for insurance against accidents and occupational diseases, it is assigned a separate tariff. This follows from paragraphs 7 and 11 of the Rules, approved by Decree of the Government of the Russian Federation of December 1, 2005 No. 713.

If the organization has such separate divisions, then determine the main type of activity separately:

  • for each separate division;
  • by the head office of the organization without taking into account separate divisions.

The procedure according to which the tariff is set for separate divisions is the same as for organizations (paragraph 2, clause 8 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55). The notification form for separate divisions is given in Appendix 7 to the Procedure approved by Resolution of the FSS of Russia dated March 23, 2004 No. 27.

A separate division that does not pay contributions on its own, as well as a structural division of an organization (for example, a workshop), can have a separate contribution rate set. This is possible in the following cases:

  • the unit is engaged in activities that are not core for the organization;
  • for this division, the organization reports separately to the FSS of Russia;
  • the organization has no arrears in insurance premiums, as well as penalties and fines for insurance against accidents and occupational diseases that were not paid on the day of filing the application (Appendix 3 to the Procedure approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55).

This follows from paragraph 7 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55.

If the organization decides to establish a separate tariff for such a division, simultaneously with confirmation of the main type of activity of the organization, provide:

  • statement. In this case, the types of activities that the organization indicated in the confirmation certificate must correspond to the types of activities listed in the application;
  • copies of documents confirming that the division conducts activities that are not core to the organization (Regulations on the division, order (extract from the order) on accounting policies).

This rule for establishing a separate contribution rate is defined in paragraph 8 of the Procedure approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55.

The decision to establish a separate tariff is made by the territorial branch of the FSS of Russia. This is done after agreement with the fund, where the submitted set of documents is sent within seven working days. The Fund reviews them within twenty working days and reports the results to the territorial branch of the FSS of Russia. After this, within two weeks, the branch of the Federal Social Insurance Fund of Russia at the place of registration of the organization must inform it about the tariff assigned to the separate unit. This is stated in paragraph 9 of the Procedure approved by order of the Ministry of Health and Social Development of Russia dated January 31, 2006 No. 55.

An example of establishing the tariff of contributions for insurance against accidents and occupational diseases for an organization that has a structural unit

Total revenue from sales of products (works) for 2015 amounted to RUB 8,000,000, including:

  • from publishing activities (OKVED code – 22.1) – 3,500,000 rubles;
  • from furniture production (OKVED code – 36.1) – 3,500,000 rubles;
  • from the sale of furniture under agency agreements (OKVED code – 51.15) – 1,000,000 rubles.

The share of publishing activities is 43.75 percent (3,500,000 rubles: 8,000,000 rubles × 100%), furniture production activities - 43.75 percent (3,500,000 rubles: 8,000,000 rubles × 100% ), activities of agents in the wholesale trade of furniture - 12.5 percent (1,000,000 rubles: 8,000,000 rubles × 100%).

Two types of activities of the organization have the greatest share. Therefore, the accountant determined which type of activity corresponds to the highest class of professional risk.

In 2021, publishing activities correspond to the 1st class of professional risk, and furniture production activities correspond to the 8th class.

The main activity of Alpha for 2021 is furniture production. It corresponds to a tariff of 0.9 percent.

Publishing activities are carried out by a structural division of Alpha. This division is not involved in the furniture production process.

Publishing activity (OKVED code - 22.1) belongs to the 1st class of professional risk, which corresponds to a contribution rate of 0.2 percent (Article 1 of the Law of December 14, 2015 No. 362-FZ, Article 1 of the Law of December 22 2005 No. 179-FZ). Therefore, it is beneficial for an organization to establish a separate tariff for a structural unit engaged only in publishing activities.

Based on the calculations made, the accountant filled out:

  • certificate confirming the main type of economic activity;
  • application for confirmation of the main type of economic activity;
  • application for establishing a separate tariff for a structural unit.

The organization submitted these documents to the branch of the Federal Social Insurance Fund of Russia at the place where Alpha was registered.

The accountant attached copies to them:

  • explanatory note to the balance sheet for the previous year;
  • Regulations on the division;
  • order on accounting policies.

The Federal Insurance Service of Russia branch assigned to Alfa a premium rate for insurance against accidents and occupational diseases for 2021, corresponding to the 8th class of professional risk. Its size was 0.9 percent (Article 1 of the Law of December 14, 2015 No. 362-FZ, Article 1 of the Law of December 22, 2005 No. 179-FZ). The publishing division was assigned a tariff of 0.2 percent.

Formula for calculating the premium

The amount of the premium is a percentage of the insurance rate. If the percentage is a fraction, it is rounded to the nearest whole number.

The surcharge is calculated using the formula:

If the difference (1-q1) or difference (1-q2) is equal to zero, then the number 0.1 should be substituted in the formula instead.

If the amount of the premium (including rounding) is less than 40, then the Social Insurance Fund will approve exactly this value. If the resulting figure is greater than or equal to 40, then the Fund will assign a premium equal to 40 percent.

Deadline for making a decision by the FSS

The decision to establish (or refuse to establish) a discount must be made no later than December 1 and sent to the policyholder (organization or individual entrepreneur) within 5 days from the date of adoption. However, the discount cannot exceed 40%.

The decision to establish a discount on the tariff for the next year must be made by the Federal Social Insurance Fund of Russia no later than December 1, 2021. Over the next five days, the FSS of Russia is obliged to notify the organization of the establishment of a discount or refusal.

Your contribution rate for injuries

To find out your rate, determine the insurance risk class of your business. This depends on OKVED, which was established last year as the main one for your company (clause 8 of the Decree of the Government of the Russian Federation of December 1, 2005 No. 713).

Each class contains types of activities that are similar in terms of injury rates and occupational diseases, and therefore in terms of insurance costs (Appendix to Order of the Ministry of Labor of the Russian Federation dated December 30, 2016 No. 851N). The higher the risk class, the higher the insurance premium rate.

For example, OKVED 18.11 “Printing newspapers” belongs to the 1st class of profit tax with a rate of 0.2%, and OKVED 05.10.1 “Mining of coal and anthracite” belongs to class 32 with a rate of 8.5%.

The main type of activity of the legal entity is confirmed annually. Before April 15, the following documents are submitted to the Social Insurance Fund (clause 3 of the Order of the Ministry of Health and Social Development of the Russian Federation dated January 31, 2006 No. 55):

  • statement;
  • confirmation certificate;
  • explanatory note to the balance sheet (for all except small businesses).

After receiving the documents, the FSS will set an insurance premium rate for you, which will begin to apply from the beginning of the current year. Until this moment, pay contributions at last year's rate.

The rate of contributions for injuries for new organizations and entrepreneurs is determined according to the first OKVED specified in the Unified State Register of Legal Entities or Unified State Register of Individual Entrepreneurs. The FSS will inform the organization of the assigned tariff in a notification.
