Prepare for the inspection using GIT checklists on personnel issues

At the end of the year, a plan for inspections of legal entities and individual entrepreneurs for the next year is officially published on the websites of the territorial branch of the Prosecutor's Office, and, of course, no one wants to find their company on the lists, especially if everything is not going smoothly for you.

If you are subject to inspection, then you need to restore order in labor protection at the enterprise as soon as possible, using GIT checklists and several other possible tools (I will give an explanation after the list of checklists for the jump).

Checklists: why are they there?

In 2021, regulatory agencies have the right to use checklists of questions during inspections (clauses 11.1-11.5 of Article 9 of the Federal Law of December 26, 2008 No. 294-FZ).

GIT checklists are a list of questions with which the state labor inspectorate checks how employing organizations comply with labor laws and regulations containing labor law standards.

The GIT checklists for 2021 were approved by Rostrud order No. 655 dated November 10, 2017. A total of 107 checklists for scheduled inspections. Using GIT checklists, inspectors can check:

  • procedure for applying for a job;
  • requirements for the content of employment contracts;
  • the procedure for establishing and paying wages;
  • procedure for establishing working hours;
  • labor protection requirements when carrying out various types of work, other requirements.

Organizations can use checklists for self-examination and preparation for inspection by the labor inspectorate.

The checklists are presented in the form of a table that includes a question reflecting the content of the mandatory requirement being checked, an indication of the normative act and its specific structural unit that contains the requirement being checked, and a column for answering the question. The subject of a scheduled inspection carried out using checklists is limited to the list of questions included in the corresponding checklist.

Checklists are a list of questions. Based on the answers to them, the labor inspector can clearly determine whether the employer complies with the mandatory requirements of the law or not. Such sheets contain a fixed number of requirements, and the inspector must check whether the employer complies with them.

Who is being checked using questionnaire forms?

An organization with any staffing level, line of activity, or organizational and legal form has the right to check itself independently by filling out the 2021 occupational safety and health checklists. But GIT inspectors plan inspections depending on the risk category to which the organization is classified (you should familiarize yourself with the risk categories in Resolution No. 875 dated September 1, 2012):

  • from January 2021, they began to check employers classified as moderate risk;
  • from July 2021 - other employers (clause 2 of resolution No. 1080 dated 09/08/2017).

New Rostrud checklists from October 2018

Since October, labor inspectorates have had new questions for businesses. Rostrud approved 26 new checklists and canceled one old one (order dated April 11, 2018 No. 201). Now inspectors have a total of 132 checklists.

Using the new checklists, inspectors will check how companies comply with labor protection requirements in various jobs, for example in the coal or meat industry. A separate sheet is completely devoted to financial liability.

Rostrud recommends that companies check how internal control is organized using the “Electronic Inspector” online service (letter dated 03/07/2018 No. 837-TZ). He offers to answer questions from checklists, identify violations and receive recommendations on how to correct them.

About the inspection plan

To find out if you are facing a scheduled inspection, you should visit the website of the regional labor inspectorate office . The plan for next year will appear in December. If you are not on the list for inspection according to the plan, then they can only come to you unscheduled. Such inspections are most often carried out based on complaints from employees or other authorities.

By the way, the fact that the company had an unscheduled inspection does not mean that it will not be included in the plan. After all, the reasons for such checks are different.

GIT checklists are an excellent tool for self-control, even if you are not expecting anyone to “visit” ☺

Thanks to them, you can identify all the flaws in your organization’s labor protection and bring everything into compliance with the requirements of labor legislation. What an incentive the state has prepared for us ☺

With constant workload in your labor protection system, you can accidentally miss something and subsequently “get a rather large fine” for this shortcoming.
