Electronic sick leave: work rules for 2021

Electronic sick leave certificates are documents that were introduced to simplify paperwork and communication between the medical institution, the employer and the Social Insurance Fund. Changes in the rules for document preparation are coming in the near future.

Paper and electronic sheets have the same legal force, as enshrined in Federal Law No. 86-FZ dated May 1, 2017. But it is written out only in one format (Part 2 of Article 1 and Part 5 of Article 13 of the Federal Law of December 29, 2006 No. 255-FZ, paragraph 1 of Article 15 of the Federal Law of July 24, 1998 No. 125-FZ). That is, an ill employee does not have the right to receive digital and paper versions at the same time.

What does electronic sick leave mean for an employer?

Sick leave is the basis for the appointment and payment of benefits for temporary disability or pregnancy and childbirth (Part 5 of Article 13 of the Federal Law of December 29, 2006 No. 255-FZ). A certificate of incapacity for work can be issued either on paper or electronically.

What should an employer do with electronic sick leave in 2021?

Employers using electronic sick leave do not need to ensure the safety of sick leave certificates. After all, all information from the moment the electronic certificate of incapacity is opened is stored in the Social Insurance Fund system, and the employer can request it repeatedly. And when the FSS conducts an inspection of the employer, there will be no need .

To start working with electronic sick leave, you need to enter into an agreement with the Social Insurance Fund. And only in this case, and also with the employee’s consent, can electronic sick leave be accepted (clause 2 of the Rules, approved by Decree of the Government of the Russian Federation of December 16, 2017 No. 1567).

Other amendments

Law No. 86-FZ also made changes to two articles of the Federal Law of November 21, 2011 No. 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation.”

An addition was made to Article 59 of Law No. 323-FZ, which regulates the procedure for examining temporary disability.

In accordance with Part 2 of this article, the examination of temporary disability is carried out by the attending physician, who alone issues certificates of incapacity to citizens for a period of up to fifteen calendar days inclusive. In certain cases, paramedics and dentists can individually issue sick leave, but for a shorter period, up to ten calendar days inclusive. In accordance with Part 3 of Article 59 of Law N 323-FZ, the extension of a certificate of incapacity for work for a longer period than specified in Part 2 of the article (but no more than fifteen calendar days at a time) is carried out by decision of the medical commission. She is appointed by the head of the medical organization from among the doctors who have been trained in the examination of temporary disability.

From July 1, 2021, in accordance with the new paragraph 3.2 of Article 59 of Law N 323-FZ, a certificate of incapacity for work can be issued in the form of a paper document or (with the written consent of the patient) in the form of an electronic document. The electronic sick leave must be signed using an enhanced qualified electronic signature by a medical professional and a medical organization.

The changes also affected Article 78 of Law No. 323-FZ, which defines the rights of medical organizations. Before the amendments, medical organizations had the right to:

  • make proposals to the founder to optimize the provision of medical care to citizens;
  • participate in the provision of medical care to citizens of the Russian Federation in accordance with the program of state guarantees of free medical care, which includes a basic program of compulsory medical insurance;
  • issue prescriptions for medications, certificates, medical reports and certificates of incapacity for work in the manner established by the authorized federal executive body;
  • carry out scientific and (or) research activities, including conducting fundamental and applied scientific research;
  • create local information systems containing data about patients and the medical services provided to them, in compliance with the requirements established by the legislation of the Russian Federation for the protection of personal data and compliance with medical confidentiality.

From July 1, 2021, the right to issue certificates of incapacity for work was excluded from paragraph 3. The medications, medical products listed in this paragraph, as well as the prescription forms issued for them, are issued in the manner approved by Order of the Ministry of Health and Social Development of Russia dated February 12, 2007 N 110. This procedure was developed in accordance with Article 6.2 of the Federal Law dated July 17, 1999 N 178- Federal Law “On State Social Assistance” and in order to provide citizens, including those entitled to receive state social assistance, with a range of social services. The list of such services includes the provision, in accordance with the standards of medical care, of necessary drugs for medical use according to prescriptions for drugs, medical products according to prescriptions for medical products, as well as specialized medical nutrition products for disabled children.

As for the right of medical organizations to issue sick leave certificates, it has migrated to the new paragraph 3.1 of Article 78 of Law No. 323-FZ. And in this paragraph we are already talking about the right to issue certificates of incapacity for work not in the manner established by the authorized federal executive body, but in the manner established by the legislation of the Russian Federation on compulsory social insurance in case of temporary disability and in connection with maternity. In accordance with Article 13 of Law No. 255-FZ, this procedure was approved by Order of the Ministry of Health and Social Development of Russia dated June 29, 2011 No. 624n. The procedure establishes the rules for making entries on a paper certificate of incapacity for work and issuing it in various insurance cases.

It should be expected that this document will also be updated after the amendments introduced by the commented Law regarding the procedure for issuing electronic certificates of incapacity for work come into effect.

  • The employer undertakes to train an accountant at his own expense so that he learns how to use the Social Insurance program. The law also allows you to hire an additional accountant who already knows the rules for using the program.
  • After completing the training, an accountant must receive from some government agency (for example, the MFC) a special electronic signature, which will confirm electronic certificates about the employee undergoing treatment. The employer must bear all official expenses for registration.
  • The design is ready. If a person has opened a certificate for undergoing treatment, then upon completion of treatment the employee is obliged to inform the accountant of a special code, which is the identification number of the certificate. After this, the accountant, using the Social Insurance program, finds the employee’s sheet and fills out his part of the certificate. Then he calculates and pays compensation for treatment within no more than 10 days after receiving the certificate, and also submits information about sick leave to the Social Insurance Fund - after some time, the employer receives monetary compensation for the person’s treatment from the Social Insurance Fund.

When will an electronic sick leave be issued in 2021, and when will a paper one be issued?

The employee reported that he has an electronic sick leave: what should the employer do?

The only difficulty in extending sick leave is changing the place of treatment. If a patient was treated in one institution and moves to another, he should notify the FSS, which will cancel the current sheet and issue a new one indicating the new medical institution. The days spent on sick leave will remain the same.

If the employer does not accept electronic sick leave

For an employee who has received a virtual illness certificate from a doctor, but is unable to obtain a certificate from the employer, it is legal to replace the virtual form with a paper one. To do this, the employee should contact the doctor who issued the electronic sick leave. The attending physician will give the patient a paper sheet, making a note on it about duplication. After filling out, indicating the number and period of illness, a paper sick leave form is given to the patient. The electronic duplicate of the sheet is destroyed.

What is the maximum payout you can receive?

Usually the calculation is made from the average payment for one day, sometimes from the minimum wage. Since the beginning of 2021, amendments have come into force, which state that the upper limit of the payment amount, in addition to the number of days missed, now depends on a number of conditions:

  • employee experience;
  • the maximum level of the base for calculating insurance premiums for insurance during a specific period.

In 2021, payments are calculated based on the salary for the previous 2 years: for 2021, income not exceeding 755,000 rubles is taken into account, for 2021 - no more than 815,000.

Since the maximum level of the contribution base increased in 2021 to 815,000 rubles, the maximum amount of payment for sick leave in 2021 increased. It amounted to 2150.68 rubles. – per day: (755,000 + 815,000)/730 days.

Employees with more than 8 years of experience can count on 2150.68. If the length of service is from 5 to 8 years, then the amount of payment will be less - 2150.68 × 80% = 1720.54 rubles per day, because under this condition, only 80% of the salary is due. If the experience is less than 5 years, then they pay 60% of the daily wage - 1290.41 rubles (2150.68 × 60%).

The minimum threshold depends on what the minimum wage was at the time of the employee’s illness. The indicator is used if the employee has little experience or the calculated payment for one day is too small.

From the beginning of January 2021, the federal minimum wage level is 11,280 rubles. The benefits are calculated specifically according to the federal indicator on the basis of clause 11.1 of the Russian Federation Regulations dated June 15, 2007 No. 37. This does not include regions with established regional earnings coefficients.

What if the benefit is more than the established limit? This occurs if the employee's average daily income is greater than the maximum threshold. The employer has the right to pay an increased amount, but the Social Insurance Fund will not reimburse funds in excess of the norm. The fund will return a portion not exceeding the upper threshold.

What documents are required with ELN, and what do they look like?

Each medical institution has its own list of documents that must be prepared to obtain an electronic sick leave. However, the package of basic documents required by the Social Insurance Fund includes:

  • an identification document of a person (most often this is a general passport, and if we are talking about a foreign citizen working in Russia, then the document that certifies the identity of such a foreign citizen);
  • a certificate from the place of work about the special name of the employer to be indicated on the sick leave;

  • if the sick leave is extended by decision of a medical and social examination or by decision of a special medical commission, it is necessary to provide a document that was drawn up following a meeting of such a commission.

In conditions where people come from other countries where the epidemiological situation with the incidence of coronavirus infection is very difficult, another document that must be provided when issuing an electronic sick leave for quarantine is an international passport in the form of scanned copies - its page with a photo and with notes on entry and exit from a country with such an epidemiological situation - or tickets for any type of transport to confirm the fact of being in the territory of such a country in the absence of marks in the international passport.

Why is ENL not available to all citizens?

An electronic certificate of incapacity for work is still not available to all persons who wish to issue it. Most often, this is due to the fact that the employer himself, whose staff includes a person who wishes to issue an electronic sick leave, has not switched to an electronic document management system with the Social Insurance Fund, as a result of which he cannot accept an electronic sick leave.

Another option, when a person cannot receive an electronic document about his disability, is that at one time or another the medical institution does not have the ability to issue an electronic version. Each person has access to information on his electronic sick leave. To do this, he can go to his personal account on the website of the Social Insurance Fund. Information verification will be carried out as follows:

  • first you need to go to the website of the Social Insurance Fund, where you need to log into your personal account;

  • from your personal account you will be transferred to the State Services website to undergo authorization there. To do this, you will need to log into your personal account on this site by entering information about your phone number, SNILS or email and your existing password, after which you will be logged into your account. If the number is unknown, then you can search by passport data or by SNILS number (since they are also linked to all sick leave), but in this case the calendar period will have to be selected manually from memory, since in the case of such a selection (for example, if a passport changed due to age or change of surname) information about all sick leave will be provided;
  • in the tab dedicated to the selected sick leave, you will be able to see all the information that is currently available on it, including regarding the calculations made for a specific sick leave.

Through your personal account at the Social Insurance Fund, you can obtain a fairly wide range of information about when the sick leave was issued, in what institution, how many days it lasted, whether there were any violations of the regime, where exactly the person was treated, and also how it was processed by the Fund itself, including in terms of calculating and making payments.

What to do if you couldn’t get an ELN

If it was not possible to obtain an electronic certificate of incapacity for work, for example, due to technical problems, the person may be issued a paper version.

If it is important for a person to receive an electronic document, he, having the data of a paper sick leave, has the right to contact the medical institution where he received the paper document and ask to be given an electronic form.

In this case, all information contained in the form will be entered into an electronic document, and the paper form will be destroyed. As soon as the electronic document is generated, the number assigned to it is communicated to the applicant so that he can provide it to his employer.

What to do if you lose your number

If for some reason the electronic sick leave number is lost, a person has three paths he can take:

  • The first - the easiest way - is to contact the medical institution where the electronic document was issued. The employee who issued this certificate of incapacity for work will help restore the lost number based on the passport data;
  • the second option, which can be used if you have an account on the State Services website, is associated with the insured person contacting his personal account. In this case, based on passport data, it will be possible to obtain information about all the sick leave that was issued to the person, and based on data on the calendar dates of the illness, it will be possible to find the exact number of the sick leave;
  • The third option is to make a request in a special form on the official website of the Social Insurance Fund indicating passport data and SNILS so that employees who work in this area can find the specified information. However, if possible, it is better to use the first two options, since restoration through a request to the FSS website can take quite a long time.

Which sick leave is better to take?

As a rule, the patient is not offered to choose which type to apply for. If technically possible, the certificate of incapacity for work will be issued electronically. Of course, the ELN is more convenient for the patient: it cannot be lost or dented, and there is no need to specifically go to the accounting department to give it away (the ELN comes there on its own via the Internet).

Sick leave when restrictive measures are introduced: nuances

The coronavirus pandemic and the implementation of measures to combat it significantly influenced the decision of legislators to approve new rules for issuing sick leave under restrictive measures.

Order 925n dated 09/01/2020 establishes that sick leave is issued for the entire period of restrictions being introduced to those persons who, due to the unfavorable epidemiological situation, are ordered to comply with the self-isolation regime.

Sick leave for the care of children under 7 years of age attending kindergartens, or incapacitated family members will be issued in cases where quarantines are introduced in kindergartens and other relevant institutions at the local or federal level.

In addition, a visit to the doctor will no longer be mandatory to obtain a sick leave certificate. Now the doctor will be able to prescribe it after seeing the patient remotely via telemedicine technologies. Such sick leave is issued only electronically by a doctor or paramedic entered in the Federal Register of Health Workers and working in a medical institution, also included in the corresponding register of medical organizations. This rule also applies to sick leave issued in connection with the upcoming birth.

What innovations have appeared in issuing sick leave when caring for family members?

Order of the Ministry of Health 925 introduced some clarifications to the registration of sick leave issued when caring for sick family members:

  1. In the new order, there are no restrictions on the number of days of sick leave when caring for children from 7 to 15 years old. According to Order No. 624, such sick leave was issued for no more than 15 days, except in cases of extension by a medical commission. However, payment of benefits will continue to be made - up to 15 days inclusive for one insured event and up to 45 days inclusive for a calendar year, since the provisions of Law No. 255-FZ in this part have not been adjusted.
  2. If older family members are ill, the maximum period for which sick leave will be issued is 7 days. He was the same before, but only by decision of the medical commission.
  3. When treating two children at the same time, only one sick leave certificate is opened, while three or more children contribute to the opening of another certificate of incapacity for work. However, this only applies to paper forms. Electronic sick leave is issued in a single version without taking into account the number of sick children.
  4. The new procedure guarantees the opening of sick leave for one parent to care for a child in cases where the second is on leave to care for another child under three years of age.

In addition to these clarifications, Order 925n of the Ministry of Health of the Russian Federation introduced changes to the reflection of information about sick family members. Now, in addition to full name the sick person and the relative will need to indicate the SNILS number of the person being cared for and the ICD code.
